Terms of Service

Brush & Gather offers guided painting experiences, including Monthly Brush events, mobile painting parties, and corporate or team-building events.

Our experiences are designed for participants ages 13 and older. We do not offer events for children ages 12 and under.

Event availability, details, pricing, and offerings may change. The details confirmed for your specific reservation will apply to that booking.

Monthly Brush events are scheduled group painting experiences. Payment in full is required at the time of booking unless otherwise stated.

Cancellation policy

• Cancellations received at least 48 hours before the scheduled event are eligible for a refund.
• Cancellations received less than 48 hours before the event are not eligible for a refund.
• No-shows are not eligible for a refund.
• If you cannot attend, you may contact us to ask whether your reservation can be transferred to another person or a future event. Transfers and credits are subject to availability and our approval and are not guaranteed.
• Cancellation requests must be sent to brushandgather@gmail.com or submitted through another cancellation method we have provided. The request must be received before the applicable deadline.
• If Brush & Gather cancels an event and cannot offer a suitable replacement, customers will receive a refund for the affected reservation.

Mobile painting parties take place at a location agreed upon with the host. The standard party price, included number of painters, event duration, and any additional charges will be communicated before the booking is confirmed.

Deposit and payment

• A $150 deposit is required to reserve your party date.
• Your date is not confirmed until the deposit has been received and Brush & Gather has confirmed your booking.
• The remaining balance is due at least 24 hours before the scheduled party.
• If the remaining balance is not received by the deadline, Brush & Gather may cancel the reservation. The deposit remains subject to the cancellation policy below.

Cancellation and rescheduling

• The $150 deposit is nonrefundable if you cancel your party, except where a refund is required by law or agreed to by Brush & Gather in writing.
• If you request to reschedule at least 7 calendar days before your event, we may apply your deposit to one new date, subject to availability.
• Rescheduling requests made fewer than 7 calendar days before the event are not guaranteed, and the deposit may be forfeited.
• If you cancel within 7 calendar days of the event, payments already made are nonrefundable, except where a refund is required by law or agreed to by Brush & Gather in writing.
• If Brush & Gather cancels a party and cannot provide a mutually acceptable replacement date, you will receive a refund of payments made for that party.

Please contact us as soon as possible if you need to change or cancel a reservation.

• Party hosts may select an existing painting from our gallery or request a custom painting idea.
• Custom painting ideas must be submitted at least 10 days before the scheduled party to allow time for preparation. Requests received after that deadline may not be accommodated.
• Custom requests are subject to approval. Any additional fees will be discussed and agreed upon before they are charged.

• For mobile painting parties, the host is responsible for providing a suitable event location with sufficient table space and seating for all participants, along with reasonable access to the event area.
• The host must ensure the space is ready for the scheduled start time. Brush & Gather is not responsible for delays caused by an unsuitable or unavailable location.
• The host is responsible for communicating relevant event details and ensuring participants meet the minimum age requirement.

If severe weather, illness, safety concerns, or other unforeseen circumstances prevent an event from taking place as scheduled, Brush & Gather will contact the customer to discuss available options, which may include rescheduling or a refund depending on the circumstances and applicable law.

Brush & Gather reserves the right to make reasonable changes to an event when necessary and will communicate material changes to affected customers.

• Prices will be displayed on our website or communicated before you confirm a booking. Any additional fees will be disclosed before they are charged.
• Payments may be processed through third-party payment providers. Their terms and privacy policies may also apply to your transaction.

• You agree to use our website lawfully and not to interfere with its operation, attempt unauthorized access, submit fraudulent inquiries, or misuse its forms, chat, or messaging features.
• Website content, including text, photographs, artwork, graphics, and branding, belongs to Brush & Gather or its respective owners and may not be copied or used commercially without permission, except as permitted by law.

You may communicate with Brush & Gather through website chat, contact forms, or text messaging where available.

Any text-message program will be subject to the disclosures and consent choices presented when you opt in. Message frequency varies, message and data rates may apply, and you may opt out of text messages by replying STOP where supported. Consent to receive promotional text messages is not a condition of purchasing Brush & Gather services.

To the extent permitted by applicable law, Brush & Gather is not responsible for indirect or consequential losses arising from the use of our website or a booking, except where such responsibility cannot legally be excluded or limited.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles, except where applicable law requires otherwise.

We may update these Terms from time to time. The current version will be posted on our website with a revised effective date. Changes will not retroactively alter a confirmed booking unless required by law or agreed to by the parties.
